Affiliate Terms & Conditions for BetOnBattles Affiliate Program

The following are our terms and conditions to become a member of BetonBattles Affiliate Program. Please read this Agreement carefully and completely.

By Linking to any of our client sites, the affiliate has agreed to be bound by all the terms and conditions set out in this agreement.

1. Enrollment

Membership in BetonBattles Affiliate Program is subject to prior approval. BetonBattles Affiliate Program reserves the right to refuse service to any new or existing Affiliate, in its sole discretion, with or without cause. Approval of membership in the BetonBattles Affiliate Program is limited only to the specific root URLs for which Affiliate has applied for approval. BetonBattles Affiliate Program reserves the right, in its sole discretion and without liability, to reject, omit or exclude an affiliate application in our sole discretion, including but not limited to, sites that are under construction, aimed at children, promote sexually explicit materials, promote violence, promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age, promote illegal activities, or violate intellectual property rights.

2. Affiliate Agreement

During the term of this arrangement (which shall commence when you indicate your acceptance in the manner specified above, and shall end when either you or we notify the other, by email, of the termination of this Agreement), you shall display a link trough the marketing tools provided by BetonBattles Affiliate Program on your site (the "Affiliate site") as a hyperlink to direct Visitors from the Affiliate Site to the Client's Sites (the Merchant program), using distinct URLs supplied by BetonBattles Affiliate Program exclusively for linking (the "Supplied Marketing Tools").

The relationship specified in this Agreement is non-exclusive for both parties; therefore, the Affiliate shall be entitled to display the banners or any other type of marketing tools of, and provide links to, sites of other companies through the Affiliate site, and BetonBattles Affiliate Program shall be entitled to make the Client's banner and other marketing tools available through online and other services than the Affiliate site.

3. Commission and Referral Bonus

Cost Per Acquisition:
Affiliates will earn a fixed referral fee from new depositing players who have made a minimum purchase of $5.00 as an entry fee to cash tournaments within BetonBattles.   This is a one-time commission payment.

On New Depositing Player Referral in the month for all transactions = $5.00 CPA

4. Payment

BetonBattles Affiliate Program shall pay any amounts due to the Affiliate monthly based on the affiliate network’s payment schedule. The minimum amount to receive a payment from BetonBattles Affiliate Program is $100 (the "Payment Threshold")

Affiliates will be paid according to the method of payment they have selected when application was submitted to the program.

BetonBattles Affiliate Program's tracking system (Through the affiliate networks) shall be the sole method for determining the basis of the calculation of affiliate commissions hereunder. 

5. Good Faith

The affiliate will not knowingly benefit from known or suspected traffic not generated in good faith whether or not it actually causes BetonBattles Affiliate Program or its client's damage. We reserve the right to retain all amounts due to the affiliate under this Agreement if we have reasonable cause to believe that such traffic has been caused with your knowledge. Even if the affiliate has not knowingly generated such traffic, we reserve the right to withhold affiliate commissions with respect to such traffic.

6. Termination

The term of this Agreement will begin when the affiliate create a unique link to BetonBattles and will be continuous unless and until either party notifies the other in writing that it wishes to terminate the Agreement, in which case this Agreement may be terminated immediately. Termination notice may be provided via email or any other public means and will be effective immediately. Upon receipt of such termination notice, Affiliate agrees to immediately remove from his/her website the BetonBattles’ link associated with BetonBattles Affiliate Program. Affiliates will be paid, in the next scheduled payment cycle, all legitimate earnings due up to the time of termination.

7. Spamming

Publisher warrants that it will not send any commercial email to any person who has requested not to receive email from the Affiliate and that they are in full compliance with the Can-Spam Act. Affiliates also understands that upon doing so it automatically forfeits the right and claim to any commission generated for its affiliate account, and Affiliate's account will be  terminated. Affiliate further agrees that all of Affiliate's business will be in compliance with all local, State, and Federal anti-spam policies and all other applicable laws.

8. Fraud and Deception

Affiliates that commit fraudulent activities, including false clicks, false impressions, and incentive based traffic will have their account removed from our Program and will not be compensated for fraudulent traffic. If fraud is suspected or detected, Affiliate’s account will be made inactive pending further investigation.

BetonBattles Affiliate Program restricts affiliates to use PPC for the following keywords to promote BetonBattles.   The keywords are : betonbattles, bet on battles, beton battles.

9. Single Account

Affiliates are NOT allowed to have multiple reseller accounts. If they are in a unique situation and require multiple accounts please contact the affiliate manager for approval. In that case, the total amount payable will be the mathematical sum of the individual accounts.

10. Relationship of Parties

For purposes of this Agreement, each party shall be and act as an independent contractor. This Agreement does not constitute, create, or give effect to any employer/employee or franchiser/franchisee relationship, nor any joint venture, partnership, limited partnership, or agency among the parties, and the parties hereby acknowledge that no other facts of relations exist that would constitute, create, or give to effect any such relationship between them. Neither party has any right or authority to assume or create any obligation nor may responsibility on behalf of the other party except as from time to time be provided otherwise by written agreement signed by both parties.

11. Indemnification

Affiliates will at all times indemnify and hold harmless the BetonBattles Affiliate Program Indemnified Parties from and against any and all losses arising out of any arising out of the Affiliate's breach of any representation, warranty or obligation hereunder, or any alleged breach of any representation, warranty or obligation to any other party.

12. Limitation of Liability
BetonBattles Affiliate will not be liable for indirect, special, or consequential damages (or any loss of revenue, profits, or data) arising in connection with this Agreement or the Affiliate Program, even if we have been advised of the possibility of such damages. Nothing in this Agreement shall be construed to provide any rights, remedies or benefits to any person or entity. Any liability arising under this Agreement shall be satisfied solely from the referral fee generated.

13. Representations

Each party represents and warrants that it has the authority to enter into this Agreement and sufficient rights to grant any licenses granted hereunder, and that any material provided by it to the other party for display on the other party's site will not infringe on any copyright, trademark or other proprietary right of any third party.

14. Confidentiality

Each party acknowledges that it will not disclose the confidential information of the other party, except to its employees and professional advisors and except as required by law.

15. Modifications:

BetonBattles Affiliate Program reserves the right to change any condition of this contract at any time; notification may be provided to Affiliates but is not required.
